1. Acceptance of Terms
By accessing or using Kanvas ("Service", "Platform", "we", "us", or "our"), provided by bFrame, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Kanvas provides an infinite canvas platform that allows users to create, organize, and share visual content including images and other media elements ("Content").
3. User Accounts
3.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must be at least 13 years old to use this Service
3.2 Account Security
- You must notify us immediately of any unauthorized use of your account
- We are not liable for any loss or damage from your failure to maintain account security
4. User Content
4.1 Content Ownership
You retain all ownership rights to Content you upload to the Service. By uploading Content, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store, display, and transmit your Content as necessary to provide the Service
- Create backup copies and derivative works (such as thumbnails or optimized versions) for technical purposes
4.2 Content Responsibilities
You are solely responsible for your Content and agree not to upload:
- Content that infringes intellectual property rights of others
- Illegal, harmful, or offensive material
- Malware, viruses, or malicious code
- Content that violates privacy rights
4.3 Content Removal
We reserve the right to remove any Content that violates these Terms or applicable law, without prior notice.
5. Subscription and Payments
5.1 Free and Paid Plans
- The Service offers both free and paid subscription plans
- Paid features are accessible only with valid subscription
- Plan limitations (storage, image count, etc.) are as described on our pricing page
5.2 Billing
- Paid subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We may change pricing with 30 days notice
5.3 Cancellation
- You may cancel your subscription at any time
- Access to paid features continues until the end of your billing period
- Content may be deleted if you exceed free tier limits after cancellation
6. Intellectual Property
6.1 Our Property
The Service, including its code, design, features, and branding, is owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the Service without permission.
6.2 Feedback
Any suggestions or feedback you provide may be used by us without obligation to you.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service
- Scrape, harvest, or collect data without authorization
- Use automated systems to access the Service excessively
- Resell or redistribute the Service without authorization
9. Third-Party Services
The Service may integrate with third-party services (e.g., cloud storage, authentication providers). Your use of such services is subject to their own terms and policies. We are not responsible for third-party services.

- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- We do not guarantee uninterrupted or error-free service
- We are not responsible for data loss; you should maintain your own backups
- We do not guarantee the accuracy or reliability of any Content
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
- These limitations apply regardless of the legal theory
12. Indemnification
You agree to indemnify and hold harmless Kanvas and bFrame from any claims, damages, or expenses arising from:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of any third-party rights
13. Termination
13.1 By You
You may terminate your account at any time by contacting us or using account settings.
13.2 By Us
We may suspend or terminate your access if you violate these Terms, or for any reason with reasonable notice.
13.3 Effect of Termination
Upon termination, your right to use the Service ends. We may delete your Content after termination.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.
15. General
15.1 Entire Agreement
These Terms constitute the entire agreement between you and us regarding the Service.
15.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
15.3 Waiver
Failure to enforce any right does not waive that right.
15.4 Assignment
You may not assign these Terms. We may assign them in connection with a merger or acquisition.
16. Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.
